Terms of Service

1. Acceptance of Terms

By downloading, installing, or using PocketNOC ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PocketNOC is a mobile application that provides monitoring and management capabilities for SolarWinds Orion infrastructure. The App connects to your organization's SolarWinds Orion server(s) to display monitoring data, alerts, and node information.

PocketNOC is an independent product and is not affiliated with, endorsed by, or sponsored by SolarWinds Worldwide, LLC. SolarWinds, Orion, and related marks are trademarks of SolarWinds Worldwide, LLC.

3. Account and Access

To use PocketNOC, you must have valid credentials to a SolarWinds Orion server that your organization operates. You are responsible for:

• Maintaining the confidentiality of your SolarWinds credentials
• All activities performed through the App using your credentials
• Ensuring your use complies with your organization's security policies
• Obtaining proper authorization from your organization before connecting to any SolarWinds infrastructure

4. Acceptable Use

You agree to use PocketNOC only for lawful purposes and in accordance with your organization's acceptable use policies. You shall not:

• Use the App to access systems you are not authorized to access
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to transmit malicious code or interfere with any network or server
• Redistribute, sublicense, or resell the App

5. Subscriptions and License Keys

PocketNOC offers auto-renewable subscriptions ("PocketNOC Pro") that provide access to premium features. By subscribing, you agree to the following:

• Billing: Subscriptions are billed through your Apple App Store or Google Play Store account on a recurring basis (monthly or annually, depending on the plan selected).
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
• Cancellation: You may cancel your subscription at any time through your App Store or Play Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
• Price Changes: We may change subscription pricing at any time. You will be notified in advance and any price increase will take effect at the start of your next billing period after notice.
• Free Trial: If offered, free trial periods convert to paid subscriptions at the end of the trial unless cancelled.

PocketNOC Pro may also be activated via license keys purchased directly through our website (Stripe). License keys are subject to the following:

• Device Binding: Each license key is bound to a single device upon redemption. A license key cannot be used on multiple devices simultaneously.
• Device Transfer: You may transfer a license key to a new device by initiating a transfer request from within the app. A confirmation email will be sent to the email address associated with the license. The transfer completes when the email link is confirmed.
• Validation: The app periodically validates your license key against our licensing server. If your device cannot reach the server for more than 7 days, the license entitlement may be temporarily suspended until connectivity is restored.
• Expiry: License keys may have an expiration date. Expired keys are no longer valid and the associated entitlement will be revoked.

6. Data Handling

PocketNOC connects directly to your organization's SolarWinds Orion server(s). Your monitoring data remains within your organization's infrastructure and is not transmitted to PocketNOC's servers, except:

• Push Notifications: In a future release, alert summary data may be routed through Apple Push Notification service (APNs) if enabled
• Crash Reporting: Anonymous crash and performance data may be collected to improve the App

7. Availability and Support

PocketNOC is provided on an "as available" basis. We do not guarantee uninterrupted access to the App. The App's functionality depends on your SolarWinds Orion server's availability and configuration. WeaveHub LLC is solely responsible for providing maintenance and support for PocketNOC. Apple Inc. has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT MONITORING DATA WILL BE ACCURATE OR COMPLETE.

In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

9. Limitation of Liability

IN NO EVENT SHALL POCKETNOC, WEAVEHUB LLC, OR ITS DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, BUSINESS INTERRUPTION, OR DAMAGES ARISING FROM MISSED ALERTS OR MONITORING FAILURES, REGARDLESS OF THE CAUSE OF ACTION.

10. Indemnification

You agree to indemnify and hold harmless WeaveHub LLC and its developers from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Intellectual Property

WeaveHub LLC shall be solely responsible for the investigation, defense, settlement, and discharge of any intellectual property infringement claim related to PocketNOC.

12. Apple App Store Terms

The following terms apply to users who download PocketNOC from the Apple App Store:

• Acknowledgement: These Terms are between you and WeaveHub LLC only, and not with Apple Inc. ("Apple"). WeaveHub LLC, not Apple, is solely responsible for PocketNOC and its content.
• License: The license granted to you for PocketNOC is a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
• Product Claims: WeaveHub LLC, not Apple, is responsible for addressing any claims relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
• Legal Compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
• Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted within the App and on our website. Continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
